Partner, Faisal spoke about the character of justice dispensation, arguing that it is essential and cannot be shut off during times of exigency, while focusing on the role of courts in the times of a pandemic. This was coupled with a flavor of the kinds of Constitutional & legal questions that may arise during a pandemic and shortly thereafter.

He also traced the history of how courts have reacted to pandemics through the ages. He presented his views in favour of the ‘Open Court System’ and the need that justice be accessible to litigants and the general public even during virtual court hearings.

Lastly, he spoke of the need to adopt an inclusive approach on matters of digitization and technology.

Our Firm’s Litigation Partner, Faisal Sherwani was invited to speak at a Webinar on the topic, “The Tools of a Lawyer: Thinking, Arguing & Preparing a Brief” organised by SPRED Law on July 11, 2020.

The format was an interactive one, where Faisal addressed queries on a number of varied subjects and issues such as the ideal conduct of a lawyer in court and his duty to his client.

This was followed by Q&A session on why procedure matters i.e. how one can gain a substantive advantage through it in litigation and dispute resolution, the rules of evidence as a tool, the utility of canons of interpretation of texts and statutes.

He particularly spoke about the textualist approach to interpretation of statutes as also, the circumstances where reference to legislative history may be permissible – while pointing out the obvious flaws in both methods.

The session was concluded with a short discussion on consistency and law from the perspective of the role of precedent in our system of justice dispensation.
