{"id":7967,"date":"2022-08-30T05:58:06","date_gmt":"2022-08-30T05:58:06","guid":{"rendered":"https:\/\/demosite.finlabsindia.org\/demo\/Luthra\/?p=7967"},"modified":"2023-09-13T17:58:30","modified_gmt":"2023-09-13T17:58:30","slug":"11-july-2020","status":"publish","type":"post","link":"https:\/\/demosite.finlabsindia.org\/demo\/Luthra\/11-july-2020\/","title":{"rendered":"The Tools of a Lawyer: Thinking, Arguing &#038; Preparing a Brief"},"content":{"rendered":"\n<p>Our Firm\u2019s Litigation Partner,\u00a0<a href=\"https:\/\/forkandflavor.in\/partners\/\"><strong>Faisal Sherwani<\/strong><\/a>\u00a0was invited to speak at a Webinar on the topic, \u201cThe Tools of a Lawyer: Thinking, Arguing &amp; Preparing a Brief\u201d organised by\u00a0SPRED\u00a0Law\u00a0on July 11, 2020.<\/p>\n\n\n\n<p>The format was an interactive one, where&nbsp;Faisal&nbsp;addressed queries on a number of varied subjects and issues such as the ideal conduct of a lawyer in court and his duty to his client.<\/p>\n\n\n\n<p>This was followed by Q&amp;A session on why procedure matters i.e. how one can gain a substantive advantage through it in litigation and dispute resolution, the rules of evidence as a tool, the utility of canons of interpretation of texts and statutes.<\/p>\n\n\n\n<p>He particularly spoke about the textualist approach to interpretation of statutes as also, the circumstances where reference to legislative history may be permissible \u2013 while pointing out the obvious flaws in both methods.<\/p>\n\n\n\n<p>The session was concluded with a short discussion on consistency and law from the perspective of the role of precedent in our system of justice dispensation.<\/p>\n\n\n\n<p>The Webinar was well attended, with the organizers receiving 700+ registrations. The program was also broadcasted on YouTube Live.
